Mate its Australia not the US we have a fairer legal system, the arse ruined your car and was driving w/o insurance - you could always take him to the small claims court for the difference between what you have spent on the car and what you have received back (including the cost of your terminated insurance policy when the car was written off). Its much easier and cheaper to self represent in the small claims court and they can use the tools available to the SDRO (the same guys who chase you around for traffic fines) to garnish his wages etc. to collect the money.

Ideally though present your case to him, show him the difference between what you spent on the car just a year ago plus what you spent since and what you're getting back and offer to settle in the middle or you'll take him to court. He wouldn't want the hassle either.

Plus you said you were in a sling and prob. missed work - this should have been covered for by his CTP policy. If he doesn't have that either then file a police report.

If you are going for CTP you need a Police report - should be reported to police with in 7 days of the accident. Get the name of the CTP insurer from him (or Police may give it to you) and lodge an intent to claim ASAP

ah bugger it. when tiny gets back im gonna send me up to john at mini king for some advice and john said he "may" fix it. rust wise tiny was pretty much straight before the accident and was all good. but i know what your say sports, ill be tossing up what to do when i do get him back.

also while he's getting fixed dads said to stripe him down and get him completely redone properly from getting rid of any excess rust, new paint, new wiring to fixed interior and if theres money left over redo the motor while its out.
