Has the second chance offer been accepted if so hit the guy the $50 if not tell him you are going to have to relist the car for sale and he will get the difference between the sale prices returned and any extra sales fees removed as well and report the guy to Ebay as a non paying bidder and negative feedback, Its the buyers responsibility to know if they can afford it before they bid

Hey Jim,

Just replied to your email, I'm the second bidder that missed out on it last time. As I said in the email, I am very interested.

As for the non-paying bidder, in essence you're loosing $50 plus the listing and associtaed ebay fees, it's only fair that he covers these. The feedback is up to you i guess.

In reality it should be you keep the deposit. That is the whole point of a deposit and that is how many deposit based purchases are made.

At a minimum I would give him back the deposit minus the Ebay fees and the $50 discount to the next buyer.

I'm liking all options at the moment....

I do feel a little "Screwed around", but at the same time, if his story is truthful, then he really does need the hand....

I think in the end I'll do the honorable thing and give him back Most of his deposit, and withhold jsut the costs to me (Ebay, banking and other fees)

He paid a $460 deposit, so I think a return of $330 is fair.. sound about right people ?

he may be honest, or he may just have cold feet and is screwing me around.. I'm not sure if my Karma can handle me making the wrong decision.

I don't think your karma will have any issues if you give him back $330. :) That sounds like a good compromise to me. You don't want to shaft the guy if he is being honest but he shouldn't get off scott free either. At the end of the day you have been dicked around and have had to waste more time and effort than if the sale had gone through. You have to cover costs and get a little bit extra for the muck around. Hope it all works out for the best.

Lately I have found ebay to be nothing but a big pile of crap!

This is soooo typical of ebay. You can bid and buy and there is NOTHING making the buyer keep their part of the 'deal'. This has happened to me 3 times in the last month. I have given up on ebay now and won't use it any more. There are many other places to sell stuff. The MCCNSW website is the best place to sell a Mini. I sold my own within 2 days, and it didn't cost a cent.

James, personally I would keep the deopsit, neg him, AND write to eBay.

Good luck with the second chance offer....I have found that after the fact, people don't seem to want to take those offers.

My response to the non-paying buyer. (And I Hope you are reading this . . . )

"Although the Law states that I am entitled to keep 100% of your deposit in order for you to pull out of the sale, I have had a good long think about the situation, and it would be ebst for all I think, if i returned most of your deposit, only withholding enough to cover my costs.
My costs to this point have been in the order of $130. and in order to be fair to both parties, I will be returning a portion of your deposit equaling $330.
I am sorry to hear of your situation.
No feedback will be left for you at all at this stage, i think this is only fair, neither positive or negative.. just let it go.
Please email me your bank details and I will have a deposit made before the end of the week.

in the last two weeks I have not had a single hour to myself to even drive the car, let alone actually do anything with it.

it will sit in my front yard and ROT unless it goes to a good home, in this case, the Ausmini Member Icarus has made me an offer, and I'm pretty sure I'll accept it. He seems to be an honest and reliable member of our community.

Spaceboy, don't make it any harder than it already is for James. He has set his priority to his Family, this is a good thing, not a bad thing. Just remember James built this himself, he will be able to do it again, if/when he wants to.

Lets Also remember mate that you were talking about selling your mini, because you bought a rice burner, I really can't see any difference in that :roll:
