Well somebody drew it and like all design it belongs to the designer and the company that commisioned it (unless they have a different agreement).

Its the same with all design, buildings, aircraft, kitchen knives,sungalsses - everything that somebody designed is covered by this.

Your right, but when do you draw the line? It's like when either Jeep(?) or Hummer took the other to court because the grills had the same amount of spaces for crying out loud! Cases like that tick me off when they're just trying to make a buck...

I think the first question you should be asking is "Why did the business go broke in the first place?".

It's happened once, and unless it's down to bad management it'll happen again. Retail businesses (restaurants especially) are particularly susceptible to the three L's.. so unless it's a viable business to begin with, in all likelihood a gimmick theme isn't going to make it viable.

Not that I think it's a bad idea, just make sure it'll work before committing time, energy and $$$$$ ;)

sorry i should of put that down

it was down to bad management the owner didnt know how to run the place and lost his head chief so its just gone down hill for him, otherwise that place is in a real good spot for exposure and something like this

There are a huge amount of images and the like that are copywrited , the shape of a glass coke bottle , mickey mouse ears (yes , two solid circles on top of a semi-circle) ,a lion roaring at the start of a movie , Harley Davidson tried to copywrite the sound of a harley and Cadbury's tried to copywrite the colour purple for chocolate wrappers .

The mini shape is identifiable and so if it's used to promote a businessyou are making money off something owned by someone else (someone who has corporate lawyers) . If you go about it properly though and get all your approvals then you'd really have a niche market and also the protection from being able to use the trademarks when anyone else who tried to copy you without the trademarks owners permission would be likely to be prossecuted .

I agree with you and BIAM, I just find it insane what people can copyright, like two circles on a semi-circle...:shock:

Jeep had a trademark which was an important part of their branding - they were just protecting their traditional market from the new guy.

The mini is a little different - they will let you use the branding if you meet their standards. Somehow I dont think any pizza Tiny cooked would meet the standard of the mini brand.

Anyhow a Paddy Hopkirk Monte Carlo Cooper S pizza with pepperoni cooked in Castrol R would taste terrible

Thing is this was like 7 years after the fact. The courts ruled that it was too late too make a claim and why hadn't they noticed before if they were so concerned :roll:

But anyway, back to the restaurant! :wink:

If you could get the rights I think it'd be good, kind of like Harry's up here 8)

sounds like a fun idea but as mentioned previously, might want to do some real research into why the last one is closing. Also have a look at your target market. Is there a demand for that kind of restaurant in that area?

"I would like a large pizza"

"So thats one large mini pizza"

"No I want a large one not a mini one"

"No it is large - we just call it mini because it sounds cool"

"OK - I ll have a mini pizza then'

"Is that a large mini pizza, a medium mini pizza or a mini mini pizza"

"A large mini pizza"

"We have a special - if you buy two medium mini pizzas we will give you a mini garlic bread for free"

"How big is the mini garlic bread"

'Mini - Its a Mini garlic bread"

"But you said that it was called mini because it was cool"

ok he closed due to poor management thats a fact, the area has one other italian restraunt but you cant dine in there its mainly take away, and you might be able to get a good word out to car clubs and such and use it to promote the place
