Unfortunately that means that it would go to court at 130kph and the police just have to say that he was clocked at that - 174kph wouldn't be mentioned.

Their was a story similar to this on one of the "current affair" shows. They ended up taking the car to a race track with a professional driver and proved the car could not do what the police claimed it was doing.

I recall that one. Police had claimed a Datsun 120y had done some ridiculous speed that it was not capable of

I think that was in Victoria and it was a point to point camera. Thousands of dollars of fines and points were refunded. The cameras were shut down for eighteen months afterwards. It's an ongoing issue in Vic over their point to point cameras.

You can request to see the readout when your booked, by law they have to show you the proof of your speed. I don't know if they keep a record that can be shown in court or they just go on what the cop says :? .

I would expect the results are recorded and kept, as the speed gun is a calibrated device which is used as evidence you would think it record things. Remember the onus of guilt is on the Govt not you, so they have to be able to prove you were speeding and a person saying so is not proof....

Whilst I find the majority of responses to your post amusing, many are offering very poor advice. Laws differ state to state and in NSW demanding to see a reading because the Police "Have to show you" and other similar advice is just plain incorrect.

Did you get a ticket or did you get a Court Attendance Notice as there will be a great difference in what may happen between the two. If indeed you were doing 74kph over the speed limit I would expect you would be fronting a Magistrate?

No way a 1098 Mini in that state of tune will do 174kmh, downhill or not. Someone has set you up...

How were you detected for speeding?

Was it highway patrol doing mobile radar, ie driving in front of you or behind you in their car
Was it lidar, ie Mr policeman standing on the side of the road with the hair dryer looking thing in his hand?

Mobile radar devices are tested/calibrated, certified and sealed at least every 12 months, in accordance with Australian Standards. Most do it every 6 months.

At the commencement and end of each operation the device is field tested for accuracy. These results are notebooked each check to confirm that the radar complies with the calibration certificate that was issued by the independant testing authority. If there is a difference in results, any infridgment notices issued during the shift are withdrawn (not actually submitted for processing) and the radar is sent away for examination and re-calibration by the independant testing authority.

Lidar devices again are tested and calibrated, certified and sealed at least every 12 months. Most do it every 6 months.

AT the commencment and end of each deployment, the lidar is field tested on a lidar range that has been measured and surveyed in accordance with the australian standards. The results obained are checked againsed the calibation certificate. IF there is a difference in results, the lidar is withdrawn and send to be tested an re-calibrated. Any infringment notices that were issued that day are withdrawn.

All police are trained in the theory, operation, testing, deployment ect of the devices. The technology used in the devices is highly advanced and the devices are very accurate when used correctly in accordance with the manufactorers specifications and australian standards. There is no legal requirement for the policeman to show you the speed that the device displayed. Most do it out of courtesy.

Before the devices are used / activated, alot of information is gathered ie displayed speed signs, target area, surroundings, locations of bends, ect ect ect before a desicion is made to intercept a vehicle, or deploy the lidar. All this will be produced in court.

There will be plenty of arm chair experts who think they know it all, oh the coppa doesnt understand the doplar principle so he cant write a ticket ect etc etc.

Ultimately, if you are going to fight the infringment notice in court, make sure you can prove your innocence beyond a reasonable doubt that you were not travelling at that speed, could't have been travelled at that speed and provide evidence. Just saying
didn't do it doesn't prove anything. You need to be able to convince the magistrate.
At 174km .... You lucky you weren't charged with dangerous driving offences.....

Over the speed limit by more than 40km/h should be instant loss of licence, vehicle impoundment and an NTA ( day in court ).
