I see it came on a trailer, not that that stops defects, some show cars got defected on their trailers a few years ago.
As an ex-cop that is impossible. The offence requires the vehicle to be driven on a roadway in a defective condition. No offence committed or every car on the back of a tow-truck following a smash is liable for a defect.
