Kevin, I agree with you whole heartedly. I believe there are far more Cooper S out there without the engine that they left the factory with than those that still have their original factory engine for the reasons that you say. Are those cars with a replacement Mk1 or Mk2 Cooper S engine still considered to be a genuine Cooper S? Yes, I believe so.
If the subject car in this thread left the factory as a Cooper S (which the pros can usually identify) and carries a Cooper S engine (which is readily identifiable) then I believe it qualifies as a Cooper S - along with the appropriate tax!
You'd be aware more than most that this is sadly an ongoing issue and I'm sure it won't be laid to rest anytime soon. Start talking about body swaps, half cuts etc etc and we're back to the original can of worms but I'm getting a bit off track!
