Post subject:  Is it Illegal to drive without....
Hi guys,

I just wanted to know is it Illegal by Queensland law, to drive without the passenger seat installed? I had a problem with my seat attachment, so needed to take the seat out, and it may not be fixed for a while, but I need the car, as its my daily driver pretty much atm. So just wanting to know if I will be breaking the law, if i drive without it? Of course, if i had a passenger they would have to use the back seats instead, but yea, is it still ok to drive legally??

I am on two minds about this, as in one cop might say yes, but the next one will say no :(. Does anyone know??

Thats a good question. I drove around melbourne for a month without one because i was moving alot of long stuff and never even gave it a thought!

I would have thought not so long as there were no jagged edges anywhere and you ahd enough seats for the passengers you had aboard

Ah but if you mini has front seat belts and you remove that seat and the rear seat positions dont have belts i believe you have broken the law. As all seat belted positions must be occupied first ?

Might be different up in QLD ?

That would be my understanding as well. Provided you don't carry passengers, it should be legal. If you sit anyone in the back and there are no legal belts except the front ones, then you have broken the law.

It is illegal in queensland. The sole reason for this is your car is complied as four seats. If you change the seating capacity/seat mounts/belt mounts etc you need to get a modification plate for the changes. In your case to comply the car as 3 seats.

You would then technically have to get another mod plate to put it back to 4 seats when you put the seat back in, as if you just take the first plate off, all the paperwork transport has still says its 3 seats.

So sure if you got pulled over the cop MIGHT let you off, but then he could also get you for illegally modifying your car and thats something you dont want to happen. I think they can impound your car now, and you lose points and a fine etc etc.

I would email the QLD motor registery (whatever they are called) and ask them. Because it's a temporary situation and so long as any passengers have seat belts it seems logical that it would be OK. Their response email (if supportive) would be proof to any cop who asks.

i cant see that it would be a problem as most modern day cars have removable seats so you CAN carry stuff.
alec was more ahead of his time than you thought....removable seats!

nah i have seatbelts in the back, as well as the front, so I would be ok there.

rehab1964- There are no sharp edges either, etc.. etc.. so yea.

Blokeinamoke - haha, of course it is, I presume this was a joke, as we are talking about the passenger seat!!

gazza- You think along the same lines as me. :) That's what I first thought, you know, it seems kinda silly otherwise, but cops can be particular sometimes i guess.

Example, all the jap vans with removable second and third row seats and compliance plates for 8 people.

IT IS TOO IN S.A..... aslong as the Vehicle has a wheel in each corner, your set, however i believe, they do NOT need to be attatched!

The drivers in Cairns use milk crates, but they place them on timber planks which are put across the floor when its totally rusted out.
