fitted everything back together as i should be radiator wise and came to fitting the top bracket, now firstly i hope i have it up the right way so i have it facing so the kink in facing downwards if you get me?! the hook part going under the forward facing thermo outlet!?

This right???

If so... Why the F$£k does the fan foul the cowling!?

Help appreciated!

What size engine is it? What type of fan....plastic or metal?
Im guessing that the radiator is verticle (same space at the top of the rad to the bottom against the radiator cowling on the inner guard), not on an angle in or out at the top?
Where in the shroud does the fan sit......it may need a spacer or spacing, or your shroud may need a small amount of adjusting in a certain spot.

is it a clubman bottom bracket with a roundnose top (i think thats why theyre different could be wrong) but mine did that but in reverse.. it was fowling on the other side.. used a smaller braket and it worked. if all else fails make your own theyre pretty simple
