Brg white roof and stripes, rego dsm747. I sold this deluxe to a guy from Melbourne who drove it back down from syd after he won it on ebay off me. On his way down he went through a toll in vic. They sent the notice to me, I got I touch with him through ebay and got it sorted. That was over 4.5 years ago. About 4 months ago I get another notice for a toll road... So i take it they just have my details on the data base. I rang everyone from vic tolls, vic rta even vic police. Nobody can help me. One guy said to fax off a detailed list of events to them and it will solve it. I am now one step off a warrant and then court if this doesn't get paid. not that i care because I can get a copy of my notice of disposal from the rta if it gets that far. Seriously what a joke. So if anyone knows of this mini would love to get this sorted with the guy. Cheers

    If it was a NSW rego at the tie you sold it and you submitted a notice of disposal then you wont go to court or at least it will be dismissed without the need to appear.

    If you didn't submit a notice of disposal then you are still legally the owner in terms of the roads authorities and liable for infringements and probably a fine for not submitting a notice of disposal. However, all that is required is a stat dec stating the fact you have not owned this vehicle for 4.5 years and that you have no knowledge of the identity of the current owner or driver of that vehicle.

    It happens all the time.

    Thanks for the reply, who do i takr the stat dec too because when i rang everyone they all said I need the new owners details and all passed the buck to the next contact claiming they couldn't help me. I'm not worried because i did hand in my n.o.d when i sold it. Half of me wants to see just how far they will go before they notice they stuffed up..

    Send it to who ever send you the latest notice and send back the notice along with it.

    Also mention in the stat dec that a N.O.D. was submitted at the time of disposal. If you still have the receipt of sale include a photo copy of that as well but have that notarised by the JP at the same time the JP notarises your stat dec - and keep copies of everything.

    The half of you that wants to see how far they go is not the right way to go. Because, without your knowledge, you may just find your licence has been cancelled for non payment of fines and you only find that out on the road side with a leering copper doing an RBT or you may find that an application for a passport has been rejected. Then you do need to go to court to have the whole mess reversed.

    They usually cancel your rego without warning these days. And then the number plate scanning camera in the police car will catch you when you least expect it...

    I had a similar drama with a parking fine I got for a car I sold a few months earlier. I rang the guy I sold it to only to find he had onsold it already. I got a stat dec and the fine was waived.

    This is very very very good advice. My poor friend got caught like this. She apparently didnt pay a $78 parking fine, doesnt recall getting any reminder for it, then gets pulled over by the police for driving an unregistered car after their cameras scanned the numberplate and flagged it.... The cops were great and thankfully let her off (still cost her a VERY expensive tow home) however they did point out that unregistered = uninsured so it could have been a real disaster for her.... especially with 4 other people in the car!!!

    Dont let it go too long... the whole system is f___ed but dont let their stupidity become detriment to you.....

    Spoke with vic police and they my licence won't get cancelled (just yet) i have until the 31st to forward the details of the new owner if not the matter gets passed onto a department where I can forward my story in writing where it will get looked at and decided if it will become a court matter. So I'm going to the rta today and getting a copy of my n.o.d. thanks again guys.

    Good luck with that- when I sold my boat & trailer I dropped the NOD in the box at Blacktown RTA and they bloody lost it.. :evil:
    Then, they chased me for the plate.. (the trailer and boat had gone to TK up in Brissy).
    I had to fill out another NOD from my records- and this time, I handed it in at the counter.

    For many years the NSW RTA has been notorious for poor service standards, inefficiency and sheer arrogance. They have got better in recent times though.

    I was quite suprised to find out that historic registered cars are not on the main system and that they have to access a different system. Given the amount of detail available to highway parol cars via the onboard internet computer, I wonder if HP officers have access to historic registered car details ???

    Off topic - I know but interesting never the less considering how we know that people have been caught in unregistered (cancelled registration) cars due to flaws in the system.

    I know a bloke that was taken to court by the RTA for driving an unregistered vehicle. They cancelled the rego due to unpaid fines.
    He fought it on the grounds that they didn't notify him. They claimed to have sent a notice, he claimed not to have received a notice. He suggested that such an important notice should be sent by registered mail to make sure it is received by the correct person.
    The magistrate agreed and threw out the RTA's case.

    All this comes down to one smart alec teenager called Jamie Partlic. Until him unpaid fines could b worked off by a minimal jail sentence. He got a week in remand and gave cheek to the wrong person and was beaten almost to the point of death.

    He survives today but with extensive brain damage and people are unknowingly driven around in unregistered and uninsured cars due to a system with holes in it.

    Have also found out the guy who purchased the mini has never registered it. Yet apparently he is still driving it around. I prefer the Swedish way of life. While over the visiting family if you get stung by a speed camera and they can't see your face you don't get a ticket. So everyone drives with their visors down lol... Again off topic.
