Post subject: | morris mini K 1969- Are rear seat belts required |
I have searched throughout the site and can not find the answer. I am not sure if I require rear seat belts in order to carry passengers. I don't normally have more the one person in the car but in the event I want to carry passengers I would like to be sure. I have called the police station and vic roads and nobody seems to be able to give me a answer. I read through the below and I don't think I need. http://www.vicroads.vic.gov.au/NR/rdonl ... /VSI21.pdf Can anyone shed some light on this? Thanks |

Has your car got seat belt points in the back? If it wasn't made with them, you don't need them. Don't think they came along till '71. |

As far as I'm aware, if the car didn't have them from new then don't need to fit them for a roadworthy. My 71 GT has rear seat belts. |

It may have points. I haven't checked. Just got the car although I remember ready in the owners manual that they are fitted with points although I don't think the rear seat belts were put in standard. |

Presuming that your car is fairly standard and not highly modified: rear seat belts were not required on new cars until 1 January 1971 (as per the tables in the document from VicRoads), so you don't require them because your car was built in 1969. If you do fit them (or anchor points to fit child seats), there are rules that you need to follow (eg location of holes and reinforcing plates to hold the bolts) and standards that you need to apply (eg using new, approved seat belts). VicRoads would have a document of some sort that either explains the requirements or refers you to the relevant national standard. (Found it: http://www.vicroads.vic.gov.au/Home/SafetyAndRules/SaferVehicles/VehicleDesignStandardsAndAccessories/VehicleStandardsInformation.htm) BUT if your car is highly modified or you do significant engine upgrades (eg turbo) then you might be required to fit seat belts as a compulsory safety upgrade. NSW requires this but I have no idea about VIC - some things vary between states. If you want a qualified professional opinion, contact an authorised automotive engineer - VicRoads has a list of approved engineers. (see the VASS list link on this page: http://www.vicroads.vic.gov.au/Home/SafetyAndRules/SaferVehicles/LicensedVehicleTesters/VehicleAssessmentSignatoryScheme.htm) Otherwise, have fun and post up some pics in the Members' Gallery! (edited for clarity and added links) |

Vic is the same on this. Some engineers are picky to the point where it only has to be an engine size increase over standard. |

No you don't need seatbelts if your car was earlier than 1971 as per above. Yes you can carry passengers with no seatbelts in the back, but if there is an available belt (ie front passenger) they must use it rather than sit in the back. No you cannot carry any children under a certain age at all because 1) they need to be in a capsule, child seat or booster and that needs seat belts and 2) you can't install that stuff in the front seat. Laws vary state to state though... |

This link is for Qld but I understand that the rules have been standardised now. http://www.legislation.qld.gov.au/LEGIS ... RURR09.pdf The relevant bits are in section 16 Basically it comes down to the age of the passenger. |
