Post subject: | Engineering Firm Gone Bust with My S Box In Their Workshop |
The engineering company that I have used for years, Kent Brake and Clutch on Port Rd, Woodville, has closed its doors. They were doing a machining job for me on my sc/cr Cooper S gearbox. I went to collect it today and the place was all closed up. A guy standing out the front said they had not paid the rent for weeks and the company was in receivership. My gearbox is still in their workshop which is well and truly locked up. How do I get it back? Any one else experienced this type of situation? |

What a bummer. ![]() As a starting point I'd say you need to contact the appointed Receiver to register your claim on the goods. If there's no receivership notices fixed to the premises a few Google searches should help find them. If you have a lawyer friend I'd also be talking to them for advice. Good luck. |

Damn thats a real bummer , but i doubt them being in recievership would affect your property " as in getting sold off " ring the owner or as mentioned the reciever. Good luck. Bill |

Contact the receiver. They know the property is not the owner of the shop so they have no claim to it. They may claim for serivces rendered but they would need to prove that has been completed. Remember withholding posession is stealing... You may however be required to prove it is yours. |

Thanks guys for these suggestions. Yes it’s a big shock. Kent has traded at the same location for 66 years. Was a family business that was sold on and seems to have gone into financial decline since. No hint of that though when I spoke to them on the phone last week about my job; they merely said it'll be ready Monday! I’m just praying someone else buys the business and keeps it going so I can retrieve my parts. Or the receiver / administrator comes to the party. Besides the brake, clutch and suspension parts supply and repair services Kent also had a well equipped automotive engineering workshop capable of doing specialised machine work. |

A recorded phone message (truncated) says they have moved premises. May not have necessarily gone bust. I could not find any notices on the ASIC website appointing an administrator (receiver/liquidator). But could not find any ABN listing for them either! Nevertheless, if they have not paid their rent & the landlord has locked the doors, one would surmise their financial position is a bit dodgy. Hope you are able to retrieve your property. |

Yeah.. But it is too late to do that now, "get in and grab what's yours" as everyone knows who it would be. It has been rebroadcast. I would have kept my mouth shut and did it. Security Lights and Alarm systems don't work on premises where the electricity has been switch off as bill was not paid! Don't forget your gloves and LED torch! And have a getaway driver with you! |

You might want to get in contact with your local Sherriffs office. A car I now own was in this kind of dispute and the paperwork that came with it talked of the Sherriff re-taking possession for the owner. They might be able to point you in the right direction if you get the right person. Cheers, HRS |

Get in touch with the receivers, let them know about your box and start the process of retrieving it. Perhaps mention it is of little financial value but you're happy to pay for the work done if any. They're not monsters, but don't move particularly fast. Chances are you will be able to arrange a time and they don't want to hold on to something that's not part of their deal. Doing damage to the property is unlikely to end well, as I think we all know. |
