That's a bummer. Firstly, it doesn't matter if you don't have insurance if it wasn't your fault but it would be easier (as your insurer would battle on you behalf, or pay you out then seek damages off the other party). Second. I don't see any advantage in rushing out and changing engines, particularly if the other one is a dud. The insurer of the other party may use it against you. Better to carry on with the fact that you have spent all this money on it and it was on the road and registered. Salvage rights usually only exist when you re insured, but I would seek more professional advice from someone like the RACV legal advice line before trying to deal with their insurer. Bit hard to tell in the dark, but it may not be a writeoff. There is a difference between a statutory writeoff (where repairs are considered unsafe) and an economical writeoff (where it would cost the insurer more than they consider the car to be worth to repair it). In that instance, they may choose to pay you out and may or not offer you the wreck depending on their policy. At worst case, you could get paid out and buy it back in the salvage auction - but it must hurt paying for your own car! I've seen worse than that get repaired BUT, the insurer will decide if it's worth it. Ps what was the other party driving? The insurer will look at the total bill not just what your car will cost. Arrange to have the car carted home or to a repairer you trust. make sure you have all the fellas details and contact his Insurance company and tell them you intend to make a claim in court for the damage. they will send assessors around and will want to just write off the car and buy you off with a cheque....no! its a classic!.....bargain with them....you want money to repair the car yourself. They may say that they will repair it at their repairer...thats OK. |

Sorry to see that, that was a pretty cool car when I saw it. As far as I know, his insurance company won't take your car for cash. It will be written off, because it is so old. Leave the engine in. It takes the value up for how much the insurance should pay you out, unless you can claim the crap engine had all the work done on it. Good luck. |

Dude i know how you're feeling at the moment. Almost. Dont give up... and you'll learn to live with the damage and drive round. Just tell im it happened when you were drifting. Works for me. Don't stress too much. |

.... this is a perfect example of why I refuse to leave my cars parked ON the road. It doesnt matter HOW careful you are, there is always somebody else out there who will ruin it for you. Hard luck for sure. |

What a bummer! I think you will find their insurers have no rights to the wreck anyway. But they may want it, depending on the company. You can insist on keeping the wreck in a case like this. Stick to your guns, and don't be too surprised when their first offer is stupidly low. Insurers are a business, so they will try and get out of it as cheaply as possible. If they insist on a stupidly low value, get Shannons or someone to assess the car for it's pre-accident value. You will have to pay a fee for this, but it may be worth it. Keep us posted! |

"Thats what I was saying....written off means the car can not be repaired and it will say so on the computer - you end up with a cheque in your hand (cheque = money = cash). Doubt if the engine is going to make all that much difference in this case, but you are right would add to the value of the wreck. Good advice about getting an independent assessment and some coloured book value to help you get a decent amount of recompense for the damage. Do NOT let them take the car if you can help it...they will whip it out to auction as quick as look at it. Any problems, just say my solicitor will be contacting you (and mean it) take it to small claims if needs be (but I bet the company backs down way before that). |

You need expert advice. I seem to remember because you are claiming on someone elses policy the car has to be fixed if you insist, no matter what the cost. Anyone hitting a stationery car is in the wrong, no arguments. I don't know what the law is in Vic, but in NSW there is a law that says all accidents have to be reported to the police within 24 hours. If this is the case in your state I would do it to get the incident on paper. Good luck. I had a similar experience and walked away from the vehicle in disgust as I could not be bothered trying to deal with getting it fixed. |

two situations: 1. friends bike written off. not his fault. he only had third party insurance, so no one was acting on his behalf Fault's insurance paid him out what they thought the bike was worth. not satisfied. 2. friends car was written off. not his fault. he had comprehensive insurance, so had the company acting for him. his own company paid him out (very good price) and they went chasing the Fault's insurance company to cover the costs. satisfied. now, if you dont mind me being negative about the situation, you dont have anyone acting on your behalf. Fault's insurance company will probably look up redbook prices and pay you what it says (not much $$). ask how they will deal with you, and if not happy, get someone to help you |
