They are trying to locate it now- but if we dont hear anything by today it will be reported to the police as stolen. We are going to consumer affairs, to at the very least get money back for the rebuild.
I think- especially if the block is gone we are also entitled to compensation for loss of value. Seeing solictor monday. It is currently insured through shannons at $10000, which was likely to rise after completion of restoration, probably be able to insure it for half that now.
Also, car is registered so we also have to change that. grrrrrr :evil:

Don't give up hope, it has to be up there somewhere.
Contact Consumer Affairs before the solictor, as you will be surprised what they can do before you have to pay for the solictor's services.

I am so sorry to hear thats happened to you. I can't believe someone would stoop that low. My deepest condolances and I hope and pray to the mini god that your car will have the correct heart in her again soon. In my opinion that company who did that to you should see the fulle extent of the law and maybe some capitol punishment. Hearing this made me nearly cry for you both and almost threw up. It makes me feel sick as to think someone would do that. Best of luck!!!!!

Don't change the details of the engine on the rego until you find out legally what can be done. Details from the Transport Department might be of use at a later date.

This is such a shame. And it is not that uncommon either that engine shops get parts mixed up, but it sounds like they are being complete arseholes about it. I have a friend with an 850, and the previous owner sent the motor in to be reconditioned, and it came back as a 'sports' 1098 with twin carbs and a LCB, coz they mixed the orders up. You have to also feel for the poor person who got an 850 when they wanted a sports 1098! Luckily they managed to get the original 850 back, so it's in the corner waiting to be rebuilt.

Hope all goes well for you. Give them the 998 back and get your 850, then perhaps send it to someone else to rebuild. I doubt they gave the 850 to somebody else, more likely they just ditched it coz a 998 is easier to rebuild.

Actually , leave it as the original engine number , when whoever has the original number uses it for rego it'll come up in the system as a red flag and you'll most likely be contacted to verify your engine number .

So if someone had our block- then we would have been informed already by transport? (assuming they have informed them of the engine change?)

Normally , once a motor is replaced and the local version of the RTA (not sure of the Qld versions name , but whoever handles rego's) is informed of an engine number change they will tell the person trying to register it the number is already in use and check it . They normally (in NSW at least) check the previous user of the engine number ( I fitted an exchange motor to my ute and didn't have it's details changed before the person who got my original motor changed their's , I got a formal letter from the RTA advising me to get a blue slip inspection and change the engine number etc .....) to see if it has been changed or someone else has stamped a block with someone elses number ......

What might he get sued for? Defamation? Note - it is only defamatory if it is untrue. Also it would be argued that it is in the public interest or public benefit.
