It depends how old the car is. If it's 76? or later it is subject to ADR 27A and they have rules about it. Basically the new motor can't be older than the old one, and the new one must have all its emission crap fitted. Makes it hard to fit an S or 1100S into a late car, if they check this.
We got pinged after putting a `74 1098 motor into a `78 (998).
Car is off the road & unreg at the moment for body repairs.
BTW they never used to bother. Used to say "WTF, it's only a Mini.."
