My shell, for my Suzuki conversion, has been at **** *********'s Mini-**** since the day after Australia Day. He wouldn't start without a $2,500 deposit and has done SFA with the car. It isn't even in his shop, but in storage somewhere!

If you find a lawyer who sorts this type of stuff, please let me know.

This is probably quite a big club - 2 1/2 years after dropping mine off to a panelbeater, with several dozen "I'm starting it next week" promises, I finally got my mini back. He then had the gall to say I couldn't take it until I'd paid in full. I felt like telling him I'd pay on the same schedule he took to get it done.

But anyway, hang in there Tricky, fantastic work. This thread is my inspiration to get mine finished off.

Whats their problem, besides having very poor business acumen and people skills?

To answer Dicko's question, no - no formal contract in writing - who does, its just a spray job right? As far as I was concerned Dicko, we shook hands on it, a gentlemans agreement. I gave the guy my word I would rewire his three sheds, and he would do the car - and as far as I was concerned, your words your bond, and an agreement is an agreement. So I actually took a week off work (yes, used one weeks annual leave), and rewired his sheds within a month!

In my book a deals a deal and he should live up to his end of the bargain.

Yeah Doc, love to, dont know any, not sure if it would make any difference. In his defence he is a bloody good spray painter and does a bloody good job, just couldnt organise a fart in his pants business wise!

Anyway, what I have in mind is to give the guy enough rope to hang himself - formal notification in writing that he has 1 month to finish the car, or repay the moneys he owes and give me the car back - in writing from my solicitor (that's $200 thankyou very much!). I guess we'll see if that works.

a lot of people now know what his business is like..
and a lot of people arent going to go there to do business with him

On a lighter note, an update as promised.

Finished off the sub-woofer board this afternoon after laying it up in the morning.

Came out just fine, all that is need now is to blacken the edes and mount it in the car (if I ever get it back :roll: ).

Here it is all trimmed to shape:

I know a panel beater that has a HQ 2 door bodyshell sitting on top of his lunchroom/toilets. It is a customers car. It was there when I did work experience there in 1978. It is still there. 8)

You don't need to get your solicitor involved. I've seen your writing ability here, you're more than capable of writing a legally threatening letter.. go the whole hog on him. He knows he's in the wrong, it's likely he'd just do the work without wanting to get legal.

I've got a solicitor's letter here somewhere from when I had to get legal on a panel shop which wrote off my '92 MR2. It got the job done easily, but in hindsight it's definitely something I could have written myself. If you like, I could shoot you a copy (it's a "Letter of Demand") before you spend $$ on the lawyer...

Good to see you wearing your gafmo saftey boots.

All is coming along well mate, just a little sad what is going on with your panel beater. I was fortunate with mine. I had my repair work done in less than a week, and then once i got the car back to him as a bare shell, it was full colour within two weeks. Had a small issue with some work, which he had fixed within a week, at no cost and no hassle, So sometime you can get good panel guys. I however had a previous issue where the car took alomst 6 months to be painted and the work wasn't what was quoted so i know how you feel. If you get really stuck, maybe you should play the Today tonight card. :wink:

Tricky you are right that an agreement that hands were shaken on is legally binding. And as SGC says you don't need to get a Solicitor involved just yet, the first step is to send him a "letter of demand" even try google-ing it you'll probably find a template you can use.

I'd say by now the best option will be to get your car out of there and recoup the money owed for the work that you did. As you need to Pressure him into getting your work done, I bet it will be an average or below average job just to get rid of you. Sad but a real possibility.

I feel for you and I know you must be really P!$$#d off by now.

You should know about "Acceptance by Conduct" , I suggest you write the letter, highlight the deal that was done and request that he completes his part of the contract. He will most likely not respond in ewriting which will then give you the upper hand. Any legal person will then argue that the deal must of been as detailed in your letter as he did not dispute this. Then you can bill him for the electrical work with the magic words "Under the Building security Act........" (do you have this in QLD?). At this point he will not pay because he will not realise what is going on and after 10 days you can take him to dispute and obtain your money - even wind him up if he does not have the money.

Sad to hear the bad news.
