hey mate, bad luck, well at least this way you have an excuse to get that gearbox fixed up while the engine is out  use the opportunity.. (owning a mini your always having to fix something  ) arrhh the fun :D as for NSW RTA paying for it, I would be suprised if they do come through...

They won't pay for the gear box..that's for sure, but they will come through
on the subframe providing NAV has enough proof. My wife severely damaged
an old Fairlane we had due to the RTA not having any signage to warn
of road works on the M3. It took a letter and then a signed declaration
that we would not sue and they paid out $5000 the value of the car.

oh no i was neva assuming they would, my point was while the subframe is out getting fixed he can fix his gearbox..

Lockie was referring to the fact that i'll be pulling my engine out shortly to change over gearboxes as I'm currently having another one built.

It's good to hear that there is hope they may pay out for the damage.
There were no signs to state a potential road hazard existed.

As far as stress relieving it goes, we are talking about common mild steel sheet here, not some aerospace alloy or high strength steel. No need, IMO.
I would just vee out the crack a little before welding, then get stuck in.
Weld it all round with the MIG, fix any other cracks too and "she'll be roight mate".
