Love the idea of a Cooper S inspired mini, I think it's only when someone try's to claim a clone as a legit that I would have issues.

If its going to be red, then black! with a red roof/wheel arches and mirrors.

I would love to see (clones / inspired by) badged as Cooper SS, let's face it you can't replicate the provinance or history, but you can be proud of what you've made. And if JC had access to Weebers, cross flow heads, overhead cams from the BMC parts bin, you think he wouldn't have bolted them on?
