I have just interrogated the Governments intellectual property database for registered trade marks and the word "
Lucas" remains a registered Trade Mark in Australia of Lucas Industries of the UK.
The protection for that trade mark is quite wide and covers five different classes, including lamps and lens. It has been continually protected that way since March 1951.
Therefore it would be a clear breach of Lucas' trade mark to remanufacture a taillight lens with the Lucas name on it in any way.
By way of interest, Lucas Industries also have their distinctive oblique chevron device registered as a trade mark in a similar range of classes. That registration is also continuous, however commenced in 1975.
I trust this assists and clears up any doubt about whether such remanufactured lens could carry branding?
Of course one could always write to Lucas and request limited licence to use their trade mark. However, I frankly would be very surprised if they would give that licence given they remain an active business in that area and the reputational and/or product liability issues that could flow? I know if I were advising them I would strongly suggest they do not give such a licence. (... I say that notwithstanding my wish it could happen! I am simply commenting as someone who has practised in that area of law.
Finally, also be wary of using similar branding but slightly changed e.g. Locus, Lucos, etc etc. Whilst not a trade mark issue per se, you could still well find yourselves in bother for "passing off". Whilst I understand such fakery is common in China etc, it is more problematic here because (a) of their legal protections here; and (b) the ease here of legally pursuing a person or entity for intellectual property breaches.
